Secrets of 1031 Exchanges

·1 hr 9 min·4 clips
Reverse exchanges can lose safe harbor if the 180-day rule is missed.
Start with the clock. Orr presents the 1031 exchange as a tax-deferred deal that rewards preparation and punishes drift. He also draws a firm advice line: he is not a tax professional or 1031 expert, and this is a classroom-style walkthrough, not legal, accounting, or professional advice. The pressure point is timing. A deal can look workable until financing, underwriting, or inspections move slower than the exchange rules allow. That is where the replacement-property list stops being paperwork and starts being the escape hatch. Orr keeps coming back to a very ordinary problem: an investor picks one property, finds something ugly in the inspection, and then discovers the backup list is too thin. The three-property rule gives the investor room. Under that rule, the investor can identify up to three possible replacement properties of any value, with the plan to buy at least one. If the first contract gets shaky, the second or third option may keep the exchange alive. Orr says investors use this setup when they really want one property, when they might buy two, or when they are still choosing among three workable deals. The 200 percent rule opens the door wider. Instead of stopping at three properties, the investor can identify more options as long as their combined value stays within 200 percent of the market value of the relinquished property. The episode stays practical, which helps. This is not a love letter to tax strategy. It is about how deadlines, inspections, underwriting, financing, and replacement choices collide when the clock is already running. Erie comes in near the end, with higher prices, higher mortgage rates, rents up, and tougher cash flow for local rental investors. The listener who gets the most out of it is someone who wants a plan before the pressure hits, will verify the rules with a competent professional, and does not want one fragile replacement option holding the whole exchange together.
