Secrets to Paperwork to Buy and Sell

Contract fundamentals
James Orr frames the session as a practical lesson on paperwork in real estate investing. He explains that in a handful of states, a state real estate commission provides standardized contracts and disclosure packages for buy and sell transactions. Those forms carry a lot of the legal and procedural weight of the deal, which is exactly why they deserve a careful read. The point is not to admire the paperwork. It is to understand what it asks for, because the details control rights, timing, and obligations. He keeps coming back to the same warning: investors need to know what they are signing before money changes hands. Earnest money is one of the clearest examples. A deposit that looks small on paper can matter a lot to a buyer with limited cash. If someone has only a thin margin left to close, a $3,000 or $5,000 deposit can become a real problem. He talks through the risk of putting down earnest money and then deciding the property is not the right fit. If the seller refuses to release the funds, the buyer may end up in a dispute over default. That can also make it harder to move on to another property. He contrasts that with a buyer who has plenty of cash and can fight over the deposit without losing the next opportunity. He then walks through the questions a careful investor should ask. What happens if there is a dispute over earnest money? How long does the return process take? Does the matter go to mediation, and who makes the decision? He also turns to good funds and asks what forms of payment are acceptable at closing. From there he moves into timing, deadlines, and the consequences of not paying on time. He notes that, in some cases, lenders may close on the property before funding the deal, which adds another edge case. The class closes by sending listeners back to their agent and financial planner with the questions they found while reading the paperwork.
